Terms of Service
Effective date: 9 April 2026
These Terms of Service ("Terms") govern your access to and use of the cafelite platform, website, and related services (collectively, the "Service") operated by cafelite.insure ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Service Description
cafelite is a policy-centric CRM platform designed for South African short-term insurance brokerages. The Service provides tools for policy management, document handling, email integration, claims workflow, task management, and AI-assisted document extraction and email analysis.
2. Eligibility & Accounts
You must be at least 18 years old and legally capable of entering into a binding agreement. You are responsible for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. You must promptly notify us of any unauthorised use.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorised access to any part of the Service, other accounts, or connected systems;
- Reverse-engineer, decompile, or disassemble any part of the Service;
- Transmit viruses, malware, or other harmful code;
- Use the Service to send unsolicited or unauthorised communications;
- Interfere with or disrupt the integrity or performance of the Service.
4. Your Data
You retain ownership of any data, documents, or content you upload or create within the Service ("Your Data"). You grant us a limited licence to process, store, and transmit Your Data solely for the purpose of providing and improving the Service.
You are solely responsible for the accuracy, quality, and legality of Your Data and for ensuring you have the necessary rights and consents to upload and process it, including any personal information of your clients or third parties.
5. AI-Powered Features
The Service uses third-party artificial intelligence providers (including Anthropic's Claude models) for features such as PDF extraction, email classification, and Record of Advice generation. You acknowledge and agree that:
- AI-generated outputs are provided on an "as-is" basis and may contain errors, inaccuracies, or omissions;
- You are solely responsible for reviewing, verifying, and validating any AI-generated output before relying on it or using it in any professional, regulatory, or compliance context;
- We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content;
- AI features should supplement — not replace — professional judgement.
6. Email Integration
If you connect your email account (Gmail, Outlook, or other provider) to the Service, you acknowledge that:
- We access and process emails solely for the purposes described in the Service (classification, linking, task creation);
- We have no control over the delivery, routing, or handling of emails by third-party email providers;
- We are not responsible for any spam, phishing, or unsolicited messages received by or sent through your email account, whether or not those emails were processed by the Service;
- We are not liable for any communications sent or received through any third-party communication platform connected to the Service.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall we, our directors, employees, agents, or affiliates be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with:
- Your use of or inability to use the Service;
- Any data loss, corruption, breach, or unauthorised access, including accidental data leaks;
- Any errors, inaccuracies, or omissions in AI-generated content;
- Any actions taken or decisions made based on information provided by the Service;
- Any interruption, suspension, or termination of the Service;
- Any third-party conduct, content, or services accessed through the Service.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or ZAR 1,000, whichever is greater.
8. Indemnification
You agree to indemnify, defend, and hold harmless cafelite.insure, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
9. Data Security
We implement reasonable technical and organisational measures to protect Your Data. However, no method of electronic storage or transmission is 100% secure. You acknowledge that:
- We cannot guarantee absolute security of Your Data;
- You use the Service at your own risk with respect to data security;
- We shall not be liable for any accidental, unauthorised, or unlawful data disclosure, loss, or breach, except to the extent caused by our gross negligence or wilful misconduct.
10. Third-Party Services
The Service integrates with third-party services including but not limited to AI providers, email providers, authentication providers, and cloud infrastructure. We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of third-party services is subject to their respective terms and policies.
11. Service Availability
We do not guarantee uninterrupted or error-free operation of the Service. We may modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.
12. Termination
We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 7, 8, 9, and 13 survive termination.
13. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
14. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify you of material changes by updating the effective date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
